One year rule

Does the fact that the circumstances are currently occurring now rather than previously justify a delay in applying for asylum? I am looking to apply for asylum and I am applying nearly after 6 years of being in the country so I wanted to find out if the fact that the incidents or circumstances are now occurring and that they weren’t occurring previously serve as a valid r…

There is indeed an exception to the one-year rule if there are 1) changed circumstances or 2) extraordinary circumstances relating to the delay in filing the application.

There are a few things to keep in mind:

1) The application must still be filed within a reasonable period of time after the changed circumstances or extraordinary circumstances occur to benefit from the exception to the one-year deadline;

2) Given it has been six years, your case and changed circumstances must be carefully analyzed by an experienced immigration attorney.

From your question, it looks like you are planning to do it on your own. It will not be easy to 1) request an exception and 2) make a strong case for asylum.

All the best!
