Asylum withdrawal
Hi. I already sent a letter. Should I receive some kind of receipt from the Asylum office in the mail?
I already sent a letter to withdraw my asylum case. However, I don’t know if they receive it or if I should do something else. I would like to know if my asylum process is already withdrawn.
Just a quick reminder about the implications of the withdrawal:
– After you withdraw your asylum application, you have to leave the United States within short amount of time or, ideally, you have to be taking actions to adjust your status. Otherwise, you will be collecting unlawful presence. Remember, you were allowed to remain in U.S. because of your pending asylum application.
– If you leave the U.S., next time you apply for non-immigrant visa, you will have hard time to convince consular officer that you do not have an intention to stay in the U.S. Given filing asylum application means you intended to stay in U.S., it will be difficult to overcome the presumption of immigrant intent;
– It is also possible that you may be suspected of frivolous asylum application. Because you claimed fear of persecution in your home country, the return to that same country may imply your fear was not genuine. This may have detrimental impact on future immigrant visa applications.
I would strongly recommend speaking to an experienced immigration attorney before withdrawing your asylum application. This way you will have clear picture of possible outcomes.
